Welcome to Daily Dashboards ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our web-based data analytics and dashboard services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
The Service is provided by SharChen Golf, Inc., dba dailyx, a Delaware corporation ("Company"). These Terms constitute a legally binding agreement between you and the Company.
Daily Dashboards provides data analytics and visualization tools, including but not limited to:
- Data visualization and dashboard creation
- SQL query execution and data exploration
- Database connections and management
- AI-powered chat and data analysis
- Chart generation and export capabilities
The Service is offered on a paid subscription basis. Specific features, pricing, and usage limits are described on our website and may change from time to time.
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your account information to keep it accurate
- Accept responsibility for all activities that occur under your account
- Maintain the security of your password and restrict access to your account
- Notify us immediately of any unauthorized use or security breach
You are responsible for any activity conducted through your account, whether or not you authorized that activity. We reserve the right to terminate accounts that violate these Terms.
4.1. Fees
You agree to pay all fees associated with your chosen subscription plan. Fees are charged in advance on a recurring basis (monthly or annually, as selected). All fees are non-refundable except as specified in Section 4.4.
4.2. Payment Processing
Payment processing is provided by Stripe, Inc. By submitting payment information, you agree to Stripe's Stripe Services Agreement and Connected Account Agreement. We do not store your complete credit card information on our servers.
4.3. Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account dashboard or by contacting customer support.
4.4. Refunds
Cooling-Off Period: You may request a refund within 14 days of your initial subscription purchase or renewal if you are not satisfied with the Service. To request a refund, contact us at [email protected] with your account details and reason for cancellation.
After the 14-day cooling-off period, all fees are non-refundable. Refunds will not be issued for partial months or unused portions of your subscription.
Each subscription plan is subject to usage quotas, including but not limited to:
- Number of queries executed per billing period
- Number of data rows processed or analyzed
- Number of database connections
- Number of dashboards created
- Storage capacity for data and dashboards
Usage quotas are specified in your plan details. If you exceed your quota, additional usage may be blocked, billed at overage rates, or require an upgrade to a higher-tier plan. We reserve the right to modify quota limits with 30 days' notice.
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law
- Infringe upon or violate the intellectual property rights of others
- Access or query databases without proper authorization
- Use automated tools to abuse, harass, or harm others
- Introduce malware, viruses, or harmful code into the Service
- Attempt to gain unauthorized access to our systems or other users' accounts
- Reverse engineer or attempt to extract our source code or algorithms
- Use the Service to compete directly with us or disrupt our operations
We reserve the right to suspend or terminate your account if you violate this Acceptable Use Policy.
7.1. Our Intellectual Property
The Service, including all software, text, graphics, logos, designs, and algorithms, is owned by the Company and protected by intellectual property laws. You receive no rights or licenses except as expressly granted in these Terms.
7.2. Your Data
You retain ownership of all data you input into the Service, including database queries, dashboard configurations, and business information ("Your Data"). You grant us a limited, non-exclusive license to use, process, and store Your Data solely to provide the Service to you.
7.3. Aggregated and Anonymized Data
We own all aggregated, anonymized, and derived data generated from your use of the Service ("Derived Data"). This includes statistical insights, trends, benchmarks, and models that do not identify you or your customers. We may use Derived Data to improve our Service and for business analytics.
7.4. Feedback
Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without obligation or compensation.
8.1. Termination by You
You may terminate your account at any time by cancelling your subscription through your account dashboard or by contacting customer support. Termination will take effect at the end of the current billing period. No refunds will be issued except as specified in Section 4.4.
8.2. Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms or our Acceptable Use Policy
- You engage in fraudulent or illegal activity
- Your payment method fails or charges are declined
- We discontinue the Service (with 30 days' notice)
8.3. Effect of Termination
Upon termination, your right to use the Service ends immediately. We may delete your account data after 30 days. Sections 5, 6, 7, 9, and 10 will survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- ACCURACY, TIMELINESS, OR COMPLETENESS OF DATA OR ANALYTICS
- UNINTERRUPTED OR ERROR-FREE OPERATION
- SECURITY OF DATA TRANSMISSION
Analytics results depend on many factors beyond our control, including data quality, database performance, and your implementation. We do not guarantee specific business outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOST PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES
- DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE
This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory.
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on our website and notifying you by email. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
Minor clarifications and corrections may be made without notice.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the federal or state courts located in Delaware.
